In an Aug. 6, 2026, letter to real estate industry executives, Warren, the ranking member of the U.S. Senate Committee on Banking, Housing, and Urban Affairs, raised concerns about the expansion of private listing networks, also known as “pocket listings” or “office exclusives.” She warned that restricting access to housing inventory and market data could reduce competition, diminish market transparency, and harm consumers.

Private listings also may prevent homebuyers from seeing important information about a property’s history. Warren’s letter specifically identifies days on the market and price change history as data that private listings can obscure. Buyers Brokers Only believes homebuyers also benefit from access to status history and other listing information that provides context about a property and its time on the market.

That information can influence how homebuyers compare home values, evaluate a seller’s asking price, and develop an offer and negotiation strategy. Warren’s letter states that buyers can suffer from reduced housing options and incomplete information that limits their bargaining and buying power.

“Days on the market, price changes, and status history are not minor details,” said Rosa, an exclusive buyer agent for more than 20 years. “Such data helps homebuyers understand the history of a property, evaluate value, and decide how to negotiate. When important information is withheld, homebuyers are being asked to make a major financial decision without the complete picture.”

Buyers Brokers Only previously warned that fragmented listing information and private listings may prevent homebuyers from seeing available homes and important property details. The company has maintained that an open marketplace benefits all consumers, providing fair access to homes.

Warren’s letter also raises concerns about the potential for private listing networks to increase same-brokerage, end-to-end transactions, often referred to as dual agency or “double-ending.” In those transactions, the brokerage represents interests on both sides of the sale.

Buyers Brokers Only shares concerns about the conflicts of interest inherent when a real estate brokerage represents both the buyer and seller, whose interests regarding price and other transaction terms are fundamentally different.

An exclusive buyer agent represents only homebuyers and works at a firm that represents only buyers, avoiding conflicts of interest common in the seller-centric real estate industry.

“When the same brokerage is on both sides of a transaction, the conflicts are clear,” Rosa, also a licensed attorney for more than 30 years, said. “The seller generally wants the highest price and most favorable terms, while the buyer generally wants the opposite. Homebuyers deserve representation focused solely on protecting their interests. Buyers should not have to choose between access to homes for sale and loyal representation.”

Private Listings Also Raise Fair Housing Concerns

Buyers Brokers Only also shares Warren’s concerns about equal housing access, having sounded the alarm more than two years ago. The senator’s letter warns that the non-public, exclusive nature of private listings may increase fair housing risks by limiting housing inventory available to some consumers and potentially making discriminatory practices more difficult to detect.

Warren specifically raised concerns that private listing networks could contribute to residential steering and create additional barriers for consumers who historically have faced unequal access to homeownership.

“Equal access to housing starts with equal access to information about what homes are available,” Rosa added. “A system that gives some buyers access to listings that other buyers cannot see deserves scrutiny. Consumers should have a fair opportunity to learn about available homes regardless of which brokerage represents them.”
