On August 17, 2026, the Court found that the complaint plausibly alleged that statements that the Fund would not hold more than 15% of its net assets in illiquid investments may have been false or misleading. Accordingly, the Court allowed certain Securities Act claims concerning the Fund’s alleged exposure to illiquid investments and understatement of its exposure to distressed assets to proceed.
